The personal rehabilitation system is a procedure in which individuals who are in a state of insolvency and have a stable income can discharge their debts by repaying a fixed amount over a period of 3 to 5 years.
Eligibility for application is limited to individual business owners who have the possibility of consistently earning a certain income from regular and certain sources, such as business income. The total amount of debt should not exceed 1 billion KRW for unsecured debt or 1.5 billion KRW for secured debt. The repayment period must not exceed 36 months, with a maximum of 60 months. In the case of real estate-secured debt, unpaid taxes, and overdue wages, almost 100% of the debt must be repaid, while the remaining debts can be discharged up to a maximum of 90%.
Although credit card payments and sales continue, there will be no disruption to business operations. If a person has more debt than the assets they currently own (such as real estate, movable property, deposits, or rental security deposits), and has grounds for insolvency, they must wait for 5 years if they have previously been granted a discharge (including discharge through bankruptcy procedures).
The general rehabilitation system is a term commonly used in practice to distinguish cases where the debt amount exceeds a certain limit for individual business owners. However, it is not a legal term.
Rehabilitation procedures are aimed at adjusting the legal relationships of creditors, shareholders, and other stakeholders in order to facilitate the efficient rehabilitation of the debtor or their business. In contrast to liquidation procedures (such as bankruptcy), which focus on disposing of the debtor’s assets and distributing them fairly among creditors, rehabilitation focuses on the reconstruction of the business and the continuation of operations, with debt repayment being the primary objective.
