Liquidation of the Bankruptcy Estate and Waiver of Rights

The bankruptcy trustee must immediately begin the liquidation of the assets belonging to the bankruptcy estate after assessing the condition of the estate. Liquidation is generally conducted through voluntary sales. Before the creditor investigation deadline, the bankruptcy trustee can only liquidate assets belonging to the bankruptcy estate with the court’s permission (Article 491 of the Debtor Rehabilitation and Bankruptcy Act). Even after the creditor investigation deadline, the bankruptcy trustee must obtain court approval if liquidating property rights concerning real estate, selling goods in bulk, selling personal property valued at over 3 million KRW, or transferring claims (Article 492 of the Debtor Rehabilitation and Bankruptcy Act).
Public Sale Information
For transparency and to ensure creditors' participation in the process, the Seoul Rehabilitation Court and Suwon Rehabilitation Court require bankruptcy trustees to publicly announce the sale of major assets. This is typically done through the public auction section of the official website of the Republic of Korea Courts under "Public Services -> Announcements -> Rehabilitation & Bankruptcy Asset Sale Notice".
Waiver of Rights in the Bankruptcy Estate
While it is customary for the bankruptcy trustee to liquidate all assets belonging to the bankruptcy estate, if liquidation is not possible or if the liquidation cost exceeds the value of the assets, the trustee may, with court approval, waive rights belonging to the bankruptcy estate (Article 492, Paragraph 12 of the Debtor Rehabilitation and Bankruptcy Act). Once waived, these rights are treated separately from the bankruptcy estate and become the debtor's free property. The debtor’s authority to manage and dispose of these rights is restored, and they become subject to enforcement by bankruptcy creditors.
